Betty Broderick Marriage Breakdown and Divorce

Dan completed his M.D. degree after the birth of his daughter Kim and expressed his interest in pursuing a J.D. degree as well.

While he attended Harvard Law School with the help of a student loan, Betty provided for the family by working part-time jobs such as selling

Tupperware or Avon products. Dan was later hired by a law firm in San Diego and moved with his family to La Jolla.

In 1982, Dan hired Linda Kolkena to be his legal assistant. Betty suspected that Dan was having an affair with Linda as early as October 1983, but Dan denied it.

Against Betty’s wishes, Dan moved out in February 1985 and eventually took custody of their children.

Betty claimed that Dan cheated her out of her rightful share of his income and used his legal influence to win sole custody of their children and sell their house.

The divorce was finalized in 1989 after a long and hostile legal battle. Betty’s behavior became erratic, including leaving hundreds of profane messages on Dan’s answering machine and vandalizing his new home.

On April 22, 1989, Dan and Linda got married, and Linda was concerned about Betty’s behavior and urged Dan to wear a bulletproof vest to the wedding.

One bullet hit the wall, and one hit a nightstand. Dan was 17 days shy of his 45th birthday, and Linda was 28.

Evidence was presented at Betty’s trial that she had removed the phone/answering machine from Dan’s bedroom to prevent him from calling for help.

Medical evidence indicated that Dan did not die right away, and Betty claimed she spoke to him after shooting him.

After contacting her daughter and her daughter’s boyfriend, Betty turned herself into the police, admitting that she had pulled the trigger.

At both trials, Betty explained that she had not planned to kill Dan and Linda and that her crime was not premeditated.

At her second trial, she claimed that she was startled by Kolkena screaming “Call the police!” and immediately fired the gun.

Jack Early, a criminal defense attorney, defended Broderick during the trial, and Kerry Wells represented the State of California as the prosecutor.

In her defense, Broderick claimed that her ex-husband had abused her for years on end, including mentally, physically, and psychologically.

However, Broderick was portrayed as a murderer who was not genuinely an abused woman by Wells, who contended that Broderick had plotted and conspired to kill her ex-husband.

Dr. Park Dietz, a forensic criminologist, and psychiatrist, testified on behalf of the prosecution and used Dr. Melvin Goldzband’s analysis, who had previously worked on the case for the prosecution.

Dietz asserted that Broderick suffered from narcissistic and histrionic personality disorders.

In addition, Goldzband labeled Broderick as “severely narcissistic” and “histrionic,” while clinical psychologist Katherine DiFrancesca, who provided testimony on behalf of the defense, said Broderick possessed “histrionic” traits along with “narcissistic features.”

The prosecution included testimony from Terry DeGelder, the case’s principal detective and a member of the San Diego Homicide Unit.

Due to two jurors’ insistence on finding manslaughter rather than murder, alleging lack of intent, Broderick’s first trial resulted in a hung jury.

The judge declared a mistrial. Broderick was retried a year later with the same defense attorney and prosecutor, and the second trial was essentially a replay of the first.

Prosecutor Wells was successful the second time around, and the jury returned a verdict of two counts of second-degree murder.

Broderick was sentenced to two consecutive terms of 15 years to life plus two years for illegal use of a firearm, which was the maximum under the law.

She has been serving her sentence at the California Institution for Women (CIW) in Chino, California since the day of the murders.
